Practical advice on RP
Visible recycling fees
The recycling fee serves to cover the costs of ecological recycling of the given electrical equipment at the end of its useful life. It should inform the consumer that after the end of its useful life, no fees will be paid for handing over the given electrical equipment to the recycling system. Stating its amount in a visible way is stipulated by the waste law.
Who does this obligation apply to?
The obligation to state the recycling fee applies to the entire distribution chain (in the same amount), i.e. from the manufacturer/importer through the distributor to the seller who sells the given electrical equipment to the final consumer.
Is it necessary to display the recycling fee in a visible way on all electrical equipment?
The obligation to display the recycling fee in a visible manner applies only to electrical equipment for household use*) and therefore not to all electrical equipment placed on the market.
Help: SEWA lists the types of electrical equipment to which this obligation applies in its price list.
How to introduce it?
The form of stating the recycling fee is defined by law and provides the following alternatives: on the tax document or a similar document or on the packaging, label or on the electrical equipment itself.
Since the recycling fee needs to be displayed in a visible way throughout the distribution chain, the most practical form seems to be to inform about the amount of the recycling fee as part of the tax document – either on the invoice or the cash register. Its amount is the same for the entire distribution chain, which means that the same amount paid by the manufacturer or importer is also paid by the seller and the consumer himself.
Example No.1 Example No.2 Example No.3 Example No.4 Example No.5
Is it sufficient to state on the tax document that the price includes the recycling fee?
The amount of the recycling fee should be precisely calculated for the given type of electrical equipment sold as a separate item.
What is the amount of the recycling fee?
In the sense of the law, the amount of the recycling fee must not exceed the best estimate of the costs of collecting, transporting and processing the given electrical equipment.
Tip: SEWA determines the amount of the recycling fee according to the type of electrical equipment per piece (not per kg). By stating the same fee as invoiced to the manufacturer/importer by its OZV/supplier, this obligation is more than fulfilled. The manufacturer does not provide an estimate of costs, but exactly the cost that the given manufacturer has with the provision of its obligations.
